DANIEL E. O’TOOLE is the Circuit Executive and Clerk of Court for the United States Court of Appeals for the Federal Circuit effective June 17, 2013.

Prior to joining the Court, Rear Admiral O’Toole served as a Navy JAG for 28 years, including as the Assistant Judge Advocate General of the Navy and Chief Judge, Department of the Navy, the position from which he retired in 2012.

Selected for flag rank in 2009, he was appointed as the first Chief Judge, Department of the Navy, responsible for all trial and appellate courts in the Navy and Marine Corps judicial system. Simultaneously, the Deputy Secretary of Defense appointed him to the U.S. Court of Military Commission Review, where he served as the Chief Judge (Acting).

In 2007, Rear Admiral O’Toole was appointed to the Navy-Marine Corps Court of Criminal Appeals, where he served as the Chief Judge.

From 2004 to 2007, Rear Admiral O’Toole served as a Chief Circuit Trial Judge and was designated the Navy’s National Security Judge.

In the headquarters Office of the Judge Advocate General, Admiral O’Toole served in multiple leadership positions, including as the Director of the Civil Litigation Division, as Director of Management and Plans, as the Director of Personnel, and as the Executive Assistant and Special Counsel to the Navy General Counsel.

Rear Admiral O’Toole also served in a series of operational posts, including USS JOHN F. KENNEDY and USS THEODORE ROOSEVELT during Operation Desert Storm.  

Before joining the Navy in 1984, he practiced law for four years in Winston-Salem, North Carolina.

Rear Admiral O’Toole is The Distinguished Graduate of the 47th Army Military Judge’s Course and an honors graduate of the Naval Justice School. He has an LL.M. from the George Washington University National Law Center and a J.D. from Wake Forest University School of Law. He has an A.B. cum laude from High Point College. Rear Admiral O’Toole is a recipient of the Maj. Gen. William K. Suter Distinguished Judicial Service Award and his military awards include the Legion of Merit (five awards).
